Terms of Service
GENERAL PROVISIONS, TERMS AND CONDITIONS
By using our service you agree to these terms. They protect both you and us, and allow us to provide a cost-effective, high-quality service.
DEFINITIONS
The following terms are used throughout this document:
– "V4Game", "Company", "Us", "Our", and "We" refer to the company V4Game;
– "Client", "User", "You", and "Your" refer to the person, organisation, or company using the services of V4Game;
– "Services" and "Service" refer to any service provided by V4Game;
– "Account" refers to the account on the V4Game website belonging to a person, organisation, or company using Our Services.
ACCEPTANCE OF THE TERMS AND CONDITIONS
The Client agrees to accept and abide by the terms of this user agreement and all conditions we set out. Any violation of these terms or conditions may result in the Services being terminated without notice. V4Game reserves the right to change these terms and conditions.
SECURITY AND ACCESS
You are responsible for the security and proper use of your logins, passwords, and any other credentials, and you must take all reasonable steps to keep them confidential, use them appropriately, and prevent unauthorised persons from obtaining them. You must notify us immediately if you have reason to believe that any login, password, or other credential has become known to anyone not authorised to have it. We are not responsible for any loss of privacy or any damage resulting from your failure to comply with these terms. You accept full responsibility for all actions taken under Your Account, whether or not they were taken with Your knowledge. You must act in a legally responsible manner when using the V4Game Services. You must not attempt to read, modify, or execute any file on our servers that does not belong to you, or attempt to access such files in any way. You must not attempt to obtain more access to a server than you have been granted. You must not use V4Game to attempt unauthorised access to, or use of, any other system or network.
SERVICES
The Services are provided as described on the V4Game website, at the prices stated on the V4Game website. We reserve the right at any time to correct, improve, or discontinue the Service (or any part of it), temporarily or permanently, with or without notice, and You agree that V4Game has the legal right to do so with respect to You or any third party. We reserve the right to change the prices of the Services.
CONFIDENTIALITY
The information you provide to us is stored on a server. We are fully committed to protecting your privacy. We will never transfer, sell, or otherwise disclose your information to any third party unless we are required to do so by law.
PAYMENT
The service is provided on a prepaid basis. Ordering Mumble server rental is itself evidence that the Client accepts these rules. The minimum prepayment period is 1 day from the date the Services are first provided to the Client, unless otherwise agreed.
CLIENT OBLIGATIONS
The User must comply with the rules set by V4Game, or stop using its Services.
You agree to notify V4Game immediately if You become aware of any unauthorised use of any or all of the Services provided to You.
Your use of the Services must comply with international law and generally accepted moral standards.
You must not use the V4Game Services for any illegal purpose. This includes, but is not limited to, posting or displaying material that is illegal, threatening, malicious, offensive, harmful, fraudulent, or defamatory; infringing the rights of any third party, including (but not limited to) intellectual property rights and copyright; or publishing information that encourages criminal activity.
You must notify V4Game immediately of any change to your email address or to any other details we need in order to contact you. V4Game cannot be held responsible for any costs arising from damage to, or total loss of, data that the Client may incur as a result of failing to notify V4Game of such changes.
You undertake to back up all your data using the facilities V4Game provides.
V4Game is not responsible for the content of any client data or information posted by the client.
The User undertakes to comply with the Rules for using the service (Appendix No. 1), which can be found here: Rules.
PRICE POLICY
The Company reserves the right to change the cost of the Services it provides, in line with economic factors affecting the Company's pricing.
TERMINATION OF CONTRACT AND REFUNDS
You can suspend your account at any time. You cannot transfer your Account to another user without giving V4Game at least 30 days' notice of your intention to do so. All payments made to V4Game are considered final: given the nature of the service and the cost of providing it, both parties accept that payments already made cannot be returned. Funds paid for the Service are not refunded for a period that has already been used. A partial refund is available where the Client has prepaid beyond the minimum payment period, that is, paid for more than 1 day.
The Services may be terminated or suspended immediately and without prior notice if the Client fails to make the payments due under the Services within the terms stated on the V4Game website, or if, at V4Game's sole discretion, the Client is unable to comply with the terms and conditions set out here.
The Company reserves the right to terminate the contract for the provision of Services to the Client unilaterally and without giving reasons. In that case, any unused funds remaining on the account will be returned to the Client.
Refunds can be made to cryptocurrency wallets or, where possible, to bank cards. The refund amount equals the funds remaining on the Client's balance, less the fees charged by the payment systems.
COMPENSATION AND FORCE MAJEURE
The Client agrees to indemnify and hold harmless V4Game, its employees, and its partners against all actions, claims, and expenses (including but not limited to legal fees) arising from Your failure to pay or from Your use or misuse of the Services provided by V4Game, and to fully indemnify any costs, losses, fines, and damages arising from the Client's violation, whether deliberate or otherwise, of the rights of a third party, including (but not limited to) intellectual property rights and copyright.
Where circumstances arise for reasons beyond V4Game's control, the Company is not liable and will not pay compensation if it interrupts or stops providing the Services. Such circumstances include:
– Technical failure, unavailability of the internet, power failure, or loss of communications;
– A DDoS attack on V4Game servers or on Data Center servers;
– Failure of any equipment responsible for server performance on the Data Center side;
– State-imposed restrictions on access to internet resources in other countries and regions;
– Government action, war, riots, protests, or strikes;
– Commercial disputes, including disputes involving our own employees;
– Extreme weather, flood, fire, explosion, or the declaration of a state of emergency.
